NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that a Public Hearing will be held before the Board of Trustees of the Village of Haverstraw, at a meeting to be held at Village Hall, 40 New Main Street, in the Village of Haverstraw (“Village”), on October 17, 2022, at 7:15 PM, concerning proposed amendments to various provisions of the Village Code, which Local law is entitled “Local Law No. ____ of 2022, Amending the Code of the Village of Haverstraw, Chapters 72, 80, 84, 97, 101, 105, 112, 120, 122, 125, 137, 141, 150, 152, 157, 159, 160, 165, 170, 171, 176, 180, 184, 189, 191, 195, 197, 200, 205, 210, 218, 227, 242 and 245, Repealing Incarceration, Imprisonment or Jail as a Penalty for Violations”. At such time and place, all persons interested in the subject matter thereof will be heard concerning same.
A brief summary of the proposed Local Law: Article 245 of NYS Criminal Procedure Law prescribes that the prosecutor’s “automatic” obligations to provide discovery to a defendant do not apply to traffic infractions, or to petty offenses as defined by a municipal code, that do not carry a sentence of imprisonment or incarceration. Imprisonment or incarceration of a defendant, convicted of any of the Village Code provisions amended by this Local Law, will be removed from nearly all of the provisions of the Village Code, since they are not crimes and the imposition of an appropriate monetary fine is adequate as a judicial sentence, and a defendant may still obtain discovery by filing a motion for disclosure in the Village Justice Court.
